Zoning Board of Adjustment Meeting Tuesday, November 10, 20156:00 P.M.*Unapproved*** See subsequent minutes for any changes Members Present: Peter Fjeld, Chair, Donna Swinington, Jeff McDonough (by phone), and Bill Shouldice Others Present: Heather Shouldice, Cheri L’Esperance, Julie Delphia, Sandra Trombley, Secretary Call to Order/Roll Call: Meeting called to order at 6:09 p.m. by Chair and roll call. Bill Shouldice recused himself from the hearing. Review Agenda: Reviewed agenda. Approval of Minutes of October 27, 2015: Motion by Jeff and second by Donna to approve minutes of October 27, 2015. All in favor. 3 yes and 1 abstention (Bill). New Business: Permit Application 26-15-ZBA Applicants: Cheri L’Esperance & Heather Shouldice, Landowners: same for property on 83 Sandy Point Lane, Parcel # 202153 Zoning District L1. Chair reconvened the hearing. Chair read the warning and explained procedures. Bill Shouldice recused himself from the hearing. There were no other conflicts of interest on the Board. Chair stated there were a couple questions the Board needed to clarify. Heather stated that most of the questions would have been answered had they gotten a piece of the application with their original application and the Board would have had all the measurements they needed, but they just got this piece of the application yesterday. Heather stated they are happy to answer any questions. The measurements are 11’ side one, 37’ side 2, rear yard 15’, 250’ from lake. The length of the structure is 14’, 10’ wide and 10’ high. A 1 story, 140 square foot utility shed. Donna mentioned another concern was; who the abutting neighbor was across the driveway. Heather stated they thought all three abutting neighbors were notified, but found out later that the owners across the driveway, Lorraine and Randall Johnson, had not been notified because they weren’t on the landowner’s abutting property list given to Sandy for noticing. Everyone has now been properly noticed and Cheri talked with Lorraine and they are fine with it. Randy has actually helped them get the area ready for the shed. He is fine with it. Heather informed they have also been personally in contact with Susan Miller who is in Texas. Heather explained that there is really no other functional place they can put the shed that won’t impact neighbors or be near the water. There was a letter from Brad Cushing for the Cushing Family LLC that was read into the record indicating no objection to the waiver. The application was for a waiver for a 10x14 accessory/utility building because it cannot meet the 25’ setback for rear and one side due to the topography which prevents another siting. Motion by Donna and second by Jeff to approve the waiver with no conditions. All in favor. So approved. The findings of fact will be written and an actual permit will be issued.
