Call to Order & Roll Call: Peter called the ZBA Meeting to order at 6:01 p.m. with roll call.
Reviewed Agenda:
Chair read the warning and explained Rules of Procedure.
01-12-ZBA Michael Rosenfeld/Beryl Howell Parcel #202113 L1, 620 Indian Trail, Leicester:
Jane Moulton, Hepatica, was in attendance representing Michael Rosenfeld and Beryl Howell. Jane was sworn in.
Kate explained that a retaining wall is a structure and therefore requires a permit. This permit requires a setback waiver because it is closer than 75’ from the lake.
There is a little bit of confusion about the plans we got for this wall and some older plans for the renovation of this house. It is possible there may be side setback waivers required for this retaining wall; as well.
Jane explained their plan is to replace the existing deck and have a sitting wall area in an arc. They want just an access area to the lake to get their canoe in.
There is old concrete to be removed. Her partner, Liz Paquette, is working on the State permits.
Jane explained the sitting wall will be dry laid Panton Stone.
There is a dock and there is at present, a deck. This is the plan without the deck.
Discussion about setbacks. The retaining wall is an arc and the 60’ doesn’t work. If the setbacks are correct the length is wrong. It’s probably 30’ – 34’. This site plan is approximate from the big site plan.
Kate stated that the question is; where is it in relation to the property lines? You have to meet the setbacks.
The Board voted unanimously to waive the setback requirement from the lake and to approve permit with the condition that they meet side setbacks of 25 feet or more. See Findings of Fact.

Motion by Jeff to adjourn meeting at 6:30 p.m. Second by James. All in favor. So approved.
