Leicester Development Review Board
The Leicester Development Review Board will hold a public hearing on Monday, August 11, 2025, at the Leicester Town Office at 6:00 p.m. to consider the following applications:
- (15-25 DRB),Application 15-25 DRB of Kelly & Ben Small, 231 Winding Way, Leicester, VT 05733, Parcel #202010 for a Section 3.7 Waiver of Setback for the construction and installation of an 8’ x 4’ storage shed adjacent to the north property line.
Applications are available for inspection at the Town Clerk’s Office, 44 Schoolhouse Rd., Leicester, VT during regularly scheduled hours.
Participation in this proceeding is a prerequisite to the right to take any subsequent appeal.

6:07 Hearing called to order. Purpose of this hearing was to consider granting a Waiver of Setback for construction and installation of a storage shed measuring eight feet by four feet by seven feet (8’x4’x7’) adjacent to the north property boundary.
Roll call was taken. Present members of the Development Review Board (DRB): Lyndsay D’Avignon, Jeff McDonough (Chair), Donna Swinington, Jay Michael. Present non-members: Keith Arlund (Zoning Administrator), Cass Tillman (Abutting Landowner). Participating via phone call: Kelly Small (Applicant), Ben Small (Applicant).
Kelly, Ben, and Cass were sworn in by Jeff.
Keith asked the applicants to explain their project. Applicants wished to construct a small shed to store water sporting accessories in (ie: life jackets, etc) ideally as close to the water as possible. Board members assessed the diagram submitted with the application. Two placements were proposed; the first is situated near the trees and immediately along the fence-line; the second is proposed next to the existing house on the northerly side. The proposed shed does not exceed standards requiring a permit, but considering the width of the property is roughly 50’, adhering to setback standards of 25’ would be impossible.
Keith asked if they had already spoken to adjacent landowners. Kelly said that Ben had only spoken to Cass about the proposal. Cass was given a turn to speak. Cass hadn’t had an opportunity to talk to Ben in-person, and was disappointed for that. Cass had printed photos from his property directed toward the northerly side of the Small’s property. These indicated that placement of a shed along the fence-line would impede the view. Both parties agreed that putting the shed along the house would be a reasonable compromise.
6:23 Kelly, Ben, and Cass were thanked for their participation and dismissed for deliberative session.
Jay Michael motioned to approve permit 15-25-DRB with the condition of new construction to be placed along the house in position #2, as labeled on permit application diagram, and so long as the shed is no closer than 14’ to the shoreline. Lyndsay seconded.
Vote held by the board: yay unanimous, so approved.
