Selectboard Meeting Minutes

Members Present: Diane Benware, Ron Fiske, Tom Barker, Ken Young, Bob Oliver
Others Present: Julie Delphia, Arlan Pidgeon, Cecile Todd, Kate Briggs, Audrey Scarborough, Sandra Chicoine, Robin Cummings, Sue Potter, Sandra Trombley, Secretary
Call to Order: Meeting called to order at 6:30 p.m. by Chair, followed by the Pledge of Allegiance.
Review of Agenda: Agenda reviewed and adjusted.
Isthmus Road:
Sandra Chicoine, Robin Cummings and Sue Potter came to address the right of way on Isthmus Road and the trees and widening the road. Each owns a residence at the end of Isthmus Road. Sandra’s summer home burnt to the ground and we are all in a hazard because the fire trucks cannot get down the road. Everyone who lives down there is in danger due to the fact that fire trucks cannot get down there. Two fire trucks could not get off from Rt.53 to Road A. The corners are the biggest problem.
Arlan and Bob went down and looked at the trees that needed to be cut. Arlan could take some down. Trees with wires through them will need professionals to remove them; either CVPS or a professional tree service.
The group of residents would be willing to take care of the trees once they were taken down. Bob Kilpeck needs to come down to review what trees need to be removed.
Bob will contact CVPS about the status of marked trees. He will ask Bob Kilpeck to come up and determine what trees need to be removed and Arlan will mark them. Once trees are identified Julie will notify landowners.
Report back in two weeks.
Approve Minutes of June 7, 2010:
Motion by Tom to approve minutes of June 7, 2010. Seconded by Ron. All in favor. So approved.
Review/Authorize Payment of Bills: Bills making their rounds.

Reports from Town Officials, Committees:
Cemetery Committee:
Audrey reported that the cemetery looks good. She presented a proposal for fencing for the front of the cemetery. The total is $3874.40 includes labor.
Tom reported that the brush and dirt pile needs to be removed.
Motion by Ron to approve the Middlebury Fence Co. proposal of $3874.40 for front piece of the cemetery. Seconded by Bob. 4 in favor and 1 abstention (Tom).
Donna Swinington will notify them.
Zoning Administrator:
Kate reported on ZBA information. Kate granted a permit on the last lot on Fern Lake on Northend Point Road. Two abutting property owners have appealed the permit. Jeff Smith is representing them. Discussion around private road issues and current zoning.
Discussion on Fairpoint upgrading phone service in Lake 2. Someone is willing to give them a site. When they have their proposal ready they will bring to the Selectboard.
Kate reported on Planning Commission. Started the process of the revising the Town Plan. Sue Potter has put Kate on the Lake Association agenda. July 14th is our next public meeting.
Town Clerk/Treasurer:
Delinquents are at $50,250 with another $1,600 just in.
She had to take the first installment of loan today to pay bills.
Discussion on dog ordinance. A resident is concerned that someone is coming onto her property where her dog is enclosed in a fenced in area and has a "Beware of Dog" sign. She questions her liability.
Board recommends the resident put a “no trespassing” sign and files it with the Town and she should contact her insurance agent.
Road Foreman:
Arlan has not done any ditching. They have done some grading. Discussion on paving. Arlan recommends doing Rte.53 from Brandon/Leicester town line, north.
Motion by Tom to go with Arlan’s recommendation of Rte. 53 Brandon/Leicester town line, north and see how far $40,000 will go. Seconded by Ken. All in favor. So approved.
Arlan will contact Gary at D&F.
FEMA expiration date is August 31, 2010. Arlan will research bigger stone for Ferson Road.
Listers:
Cecile shared article in Rutland Herald about CLA.
Cecile gave a proposal to the Board from the second company, VT Municipal Assessor for the reappraisal.
Cecile printed the guidelines for the Board.
Cecile prefers firm #1, APAS, LLC.
· Will represent at Lister’s hearings
· Will represent at BCA hearings
· Really impressed her. He knows the software.
Cecile reported that Tim preferred firm #2, VT Municipal Assessor and his reasons were:
· One person collects all the data
· Set price even if more houses were added
· Tim feels it doesn’t look right because someone from the other firm came and helped Cecile for the day.
Kate reported that she prefers APAS, LLC. Both firms are willing to start immediately. Both firms are well qualified. Due to our relative lack of experience, APAS, LLC was more direct in teaching and pointing things out.
The Board reviewed proposals.
Motion by Tom to recommend the selection of APAS, LLC based on lister recommendation. Seconded by Ron. All in favor. So approved.
Cecile will contact APAS with other questions and let them know that the Board is expecting a contract for review.

NEW BUSINESS:
Tim wanted Cecile to ask what was being done about mosquitoes. Is anyone spraying?
He needs to call Mosquito Control and the number is posted outside on the bulletin board.
OLD BUSINESS:
Ancient Roads:
Ron reported that any ancient road that is clearly recognizable, we can put on the VTrans map at any time. Anything that isn’t clearly visible for 100 yards is not. Stove Pipe is 90% clearly visible. It’s a grey area.
The other road is Isthmus Road.
Before July 1, the Board needs to make a decision.
Motion by Tom to retain as Class IV highways the continuation of Stove Pipe Avenue designated as road #21 and Isthmus Road designated as road #1 identified in Compendium of Official Records Pertaining to Ancient Public Highways Not Shown On Current Highway Maps Located Within The Town of Leicester, Vermont compiled by Michael Magoon, dated July 2009. Seconded by Bob. All in favor. So Approved.
Discussion of four wheelers on Stove Pipe. Discussion of putting up a gate and give landowners keys. Ron will get back to the Board.
Diane talked with the Brandon Police. The Chief explained they don’t generally come out here, but sometimes they have reasons to come out, i.e. restraining orders, pursuit, no trespass order, relief from abuse order, etc. There are times if a resident calls the State Police, they tell them to sometimes call the Brandon Police.
Motion by Ron for three board members to come in to sign CVPS easement. Seconded by Bob. All in favor. So approved.
Limited Public Opinion: None
Motion by Bob to adjourn at 8:10 p.m. Seconded by Ken. All in favor. So approved.
