Board of Abatement Meeting
July 23, 2019
Present: Hilary Hatch, Greg Bernhardt, Cheryl Morrison, Diane Benware, Brad Lawes, Tom Barker, Julie Delphia
Listers Office: Theresa Giles (NEMRC), Dianne Harvey
Call to Order 6:33pm
Greg moved and Cheryl seconded to reappoint Diane Benware as chair of the board. Passed unanimous with Diane abstaining.
Julie indicated that she spoke with Mr. Carroll earlier in the day and he told her to cancel their request. Julie did not have anything in writing so the board chose to continue with the hearing.
Carroll Hearing
Theresa and Diane indicated that this same property had been brought to the BOA in 2014 and had been denied as it did not meet the requirements for abatement. No changes have been made to the assessment since that time.
They presented Exhibit 1-7
Tom made a motion and Hilary seconded that the request did no met the requirements for review by the Board of Abatement and that Julie send a letter to Mr & Ms. Carroll stating the following:
Passed unanimously.
The Leicester Board of Abatement has considered your request for abatement of taxes on your mobile home located at 1413 Lake Dunmore Road. Mr. Carroll’s verbal notification to withdraw the abatement request was considered, but due to the lack of a written withdrawal, the Board chose to continue with the hearing.
The lister card shows the mobile home replacement cost at $300.00 (an assessment in line with use as a storage building). Site improvements of water and septic still remain, even if not in use. The land value remains the same. This value has not changed since your Abatement request in 2014.
In response to your request for abatement of taxes associated with your mobile home at 1413 Lake Dunmore Road:
It was determined by the Board of Abatement, based on evidence presented, that no errors were present and this request does not meet the statuted requirements for consideration by the Board of Abatement. (24 V.S.A. § 1535)
Motion by Greg and seconded by Cheryl to adjourn. Passed unanimously.
