The Board of Abatement for the Town of Leicester will be meeting on the following dates and times in the Leicester Town Office.

APPLICANTS SHOULD APPEAR AND BE READY TO PRESENT THEIR EVIDENCE AT THE DATE AND TIME SET FORTH BELOW. IF AN APPLICANT (OR REPRESENTATIVE OF THE APPLICANT) FAILS TO APPEAR AT THE HEARING, THE ABATEMENT REQUEST WILL BE DECIDED ON THE BASIS OF THE INFORMATION SUBMITTED IN THE ABATEMENT REQUEST FORM.

Minutes: Board of Abatement 02/26/2024

Present: Diane Benware, Tom Barker, John Rouse, Hilary Hatch, Cheryl Morrison, Julie Delphia, Diane Randall, Beth Ripley, Matthew Ethier, Lesley Bienvenue

 

Meeting Called to order at 7:00pm. 

 

Motion by Julie, second by Tom, to appoint Diane Benware as Chair.  All in favor.  Diane abstained.

Motion by Julie, second by Diane B, to appoint Tom Barker as Vice-Chair.  All in favor. Tom abstained.

Review of Board of Abatement Rules of Procedure.

 

 

Hearing (7:05pm): Matthew Ethier, 32 Jenna Lane, Parcel#050010

All members of the BOA and Mr. Ethier were sworn in.

Mr. Ethier’s Testimony:

  •       Mr. Ethier purchased the property at tax sale in April 2022.
  •       Mr. Ethier mistakenly thought the 2022 taxes were paid.
  •       Mr. Ethier owns other properties in town.
  •       2022 taxes were sent to the Taylors, Mr. Ethier did not receive.
  •       Mr. Ethier purchased the property prior to the redemption period in December 2022.
  •       Deed was after taxes were due.
  •       Mr. Ethier paid the 2023 taxes on this property.
  •       Received delinquent tax bill for 2022. 
  •       Contacted DTC who had updated address from 32 Jenna Lane to his mailing address.

 

        DTC Testimony:

  •       Mr. Ethier purchased the property at tax sale 4/2022.
  •       Taxes went delinquent on 11/16/2022.
  •       Mr. Ethier purchased the property before redemption on 11/28/2022, filed 12/27/2022.
  •       Penalty and interest were assessed prior to closing.
  •       Delinquent tax notices were sent to 32 Jenna Lane.

 

 

Hearing Closed at 7:14pm

 

 

The board entered deliberative session at 7:15pm.

The board exited deliberative session at 7:45pm.

 

Motion by Julie to adjourn at 7:45pm.
