Town of LeicesterSpecial Selectboard MeetingTues., Dec. 22, 2015Town Office 6:30 p.m. Present: B. Lawes, K. Young, T. Barker. R. Fiske, D. Benware (recorder) Other: Julie Delphia Meeting called to order at 6:30 p.m. by the Chair. The agenda was reviewed. Diane re-capped that Brad had forwarded copy of permit (for application of herbicide onto waters of Lake Dunmore by Aquatic Control Technologies) to her and then was distributed to all prior to the meeting. Diane sought advice from Town Counsel and reported: 1. If the town were the applicant, we could be liable for exposure from third parties as well as the state of Vermont as a regulatory body. Our PACIF coverage from VLCT does not cover any exposure from the application of the herbicide. Other concerns were raised: as to why Leicester and not Salisbury applying, as the majority of the target areas are in the north end of the lake? Was the municipality applying simply a cost-saving measure? Will this permit impact the way the milfoil grant is handled? After discussion, Brad made the motion, based on advice from Town Counsel, to propose that the Town of Leicester reimburse the Fern Lake/Lake Dunmore Association for the application fee and that the Association apply for the permit. Tom seconded the motion, which passed unanimously. Brad planned to speak to Jim Foley Wednesday morning to apprise him of our action.
