Zoning Board of Adjustment Meeting Minutes

Members Present:   Donna Swinington, Connie Carroll, Jeff McDonough

 

Members Absent:  Pete Fjeld, Bethany Menkart

 

Others Present:  Kate Briggs, Kathryn Thibeaux, Steve Beck, Sandra Trombley, Secretary

 

Call to Order & Roll Call:  Donna called the ZBA Meeting to order at 6:00 p.m. with roll call.

 

Reviewed Agenda:  

 

Members of the Zoning Board of Adjustment introduced themselves.

 

Donna read the warnings for Point Counter Point and Patrick & Kathryn Thibeaux.

 

Donna read procedures and instructions for Interested Party Status and asked everyone to sign in.

 

Donna asked if there were any conflicts of interest and/or ex parte communications by Board Members.

 

The two Interested Parties were sworn in; Steve Beck and Kathryn Thibeaux.

Kate explained that a non-residential building requires a 50’ setback from the road.  This almost met that set back, but not quite.

 

Steve Beck and Kate Briggs explained the plan.  Due to increased activity in the summer with campers and programs is basically renovating with a porch on one side and moving a wall out 4’.  This is where the campers eat and performance space, their kitchen, their dining room.  They desperately need more space.  They are making it a little wider on each side.  The side on the lake side meets any setback requirement.  It’s the side going toward the road.  It’s not that close to the road, but there is that 50’ as opposed to 25’ requirement for non-residential use. 

 

There were no other letters or persons of opposition to this application.

 

 

 

Donna explained that the hearing is now closed and the Board will be going into deliberative session at the end of the regular meeting.

 

Donna thanked Steve for coming, and explained that a written decision will be done within 45 days of decision.

 

32-11-ZBA Patrick & Kathryn Thibeaux Parcel #212039 L1/L2

 

Kathryn brought photos of the site to go along with the plan in the application.  The stone work

does not require a permit, but what she is asking is for the stairs to get to them.   Kathryn explained the plan and photos.

 

The reason they need a setback waiver is because the line is so steep, the platform is not 75’ from the water and does not meet the setback requirement from the water. 

 

There will be less linear footage of stairs than what is existing; and a much more attractive plan.  Proposed to be built as close to the ground as possible and will be landscaped.  The first plans were not good plans and they did not clearly understand the questions presented to them.

 

Letters of support were presented by Chair from members of the Mountain View Association.  These letters were given to Secretary by Kate who received them by email:

Motion by Jeff to approve minutes of August 30, 2011.   Second by Connie.  All in favor.  So approved.

Motion by Jeff to adjourn regular meeting at 6:30 p.m. and go into deliberative session.  Second by Connie.   All in favor.  So approved.

 

Next ZBA meeting  October 25, 2011.  Potential of three applications to be heard.
