Members Present:  Peter Fjeld, Donna Swinington, Jeff McDonough, Suki Fredericks
 
Members Absent: Bill Shouldice, Hannah Sessions, Alternate

Call to Order:  Meeting called to order at 6:03 p.m. by Chair. 
 
Review of Agenda
 
Roll Call:
 
Approval of March 28, 2018 minutes:
 
Motion by Jeff and second by Donna to approve minutes of March 28, 2018 as written.  All in favor.  So, approved.
 
Peter explained the procedures for conducting the DRB Hearing.
 
There were no conflicts of interest and/or Ex Parte communications by Board members.
 
Peter read the oath; and all applicants were sworn in.
 
Peter read the Public Notice for both hearings.
 
Hearing #1 03-19-ZA for Applicant: Cyd Isleib & Carol Aines, Parcel ID# 070031.1, 734 Ferson Road, (RA):
 
No written information from parties other than the applicant’s site plan and application and notes from Zoning Administrator.
 
Cyd presented the application for a new 10’ x 12’ shed with 96 sq. ft. attached lean-to for storage that does not meet the 75-foot set-back on Wheeler Road side.  She explained the diagram where they built their new house and garage. It is only not meeting one set-back which is on Wheeler Road side.
 
Cyd explained to the Board the reason they couldn’t meet the set-back was because of the wetlands on the property and this spot is the highest possible spot.  Everything else drops right off sharply.
 
Anna Scheck, Zoning Administrator provided her notes; as well as, maps to show the wetlands.  They meet all the other requirements.
 
The Board did not have any further questions. The Board will go into Deliberative Session after both hearings.
 
Hearing #2 02-19-ZA for Applicant:  Ashley Wolff, Parcel ID# 202150, 37 Rustic Ct, (L1 & L2)
 
There was an email sent this morning to Anna from adjoining property owners, Barry & Annette Huver.  They are concerned about the water run-off with the proposed building.  They could not be at the hearing.  They share the driveway and there is a history of ruts caused by water run-off. They questioned whether this building would contribute or cause additional run-off issues.  Anna read the email to the Board and applicant.
 
Ashley Wolff presented their proposed 36’ x 16’ 600 ft. studio/storage building.  The structure will be a private studio space.  She is a self-employed artist and is in need of empty wall space for illustrating, space for an etching press, easel and storage.  One big room with a small bathroom and storage.
 
The drainage history appears to be from the road and not from her property.  She has built water bars in the road and has perforated pipe in their driveway.
 
Ashley stated she has to cut down three trees to build the studio.
 
Peter asked if she has a permit from Shoreland.
 
Ashley has been corresponding with Laura Dlugolicki from Shoreland Protection.  Because a final decision hasn’t been made by Shoreland, Laura sent Ashley an email stating that she has been reviewing her Shoreland permit development project.  The project will create approximately 392 square feet of new impervious and approximately 790 square feet of cleared area within the protected Shoreland.  The proposed project conforms to all the standards of the Shoreland.  The draft permit will go through a final internal review prior to being approved.  She couldn’t give Ashley a final decision prior to tonight’s meeting, but offered to send the email.
 
Jeff stated that she would need to get the Shoreland Permit first before a Conditional Use could be given.
 
Jeff asked about the run-off and if Ashley thought this structure would make a major difference in the driveway. 
 
Ashley didn’t think it would make any difference. It’s in the woods.  Water wouldn’t come down through the woods.  This part won’t drain to their driveway.  She didn’t believe it would make it any worse.  
 
Anna Scheck, Zoning Administrator, provided her notes.  
 
Before the Zoning Administrator can issue a permit, she would need the permit from Shoreland.
 
Motion by Suki and second by Donna to go into deliberative session at 6:37 p.m.  All in favor.  So, approved.
 
Motion by Jeff and second by Peter to come out of deliberative session.  All in favor.  So, approved.
 
Motion by Jeff and second by Peter to approve permit application #03-19-ZA for Cyd Isleib/Carol Aines, Parcel #070031.1, RA.  All in favor. So, approved.
 
Motion by Peter and second by Jeff to approve permit application #02-19-ZA Conditional Use for Ashley Wolff, Parcel #202150, 37 Rustic Ct., L1 & L2 contingent on Shoreland Protection Permit.  All in favor. So, approved.
